TikTok在美國是否禁用一事有了新進展。6個月前，白宮宣稱，美國政府與TikTok的談判已經結束，字節跳動有兩個選擇：出售TikTok或等待國會通過全國禁用TikTok的法案。近期根據美國華盛頓郵報(Washington Post)報導，CFIUS(Committee on Foreign Investment in the United States, 美國境外投資委員會)已跟TikTok溝通了與上述兩選擇不同、被稱為"Project Texas(德克薩斯計劃)"的第三方案；華盛頓郵報轉述會出現第三方案的原因是，TikTok的用戶太多，代表了太多選票，“沒有人願意在選舉年攻擊TikTok(No one wants to bang on TikTok in an election year)”。
根據華盛頓郵報報導，海擇資本歸納"Project Texas"的幾個重點：
1. 字節跳動將把TikTok美國區業務的管理權交給一個三人董事會，該委員會的成員將由CFIUS選擇。

There have been new developments regarding the issue of TikTok being banned in the United States. Six months ago, the White House announced that negotiations between the US government and TikTok had concluded, giving ByteDance two options: to sell TikTok or wait for Congress to pass a bill banning TikTok nationwide. According to a recent report by the Washington Post, the Committee on Foreign Investment in the United States (CFIUS) has communicated a third option with TikTok, different from the aforementioned two, called "Project Texas." The Washington Post noted the reason for introducing a third option is the vast number of TikTok users, which represents many votes, "No one wants to bang on TikTok in an election year."
Based on the report by the Washington Post, Haize Capital summarizes the key points of "Project Texas" as:
1. ByteDance will hand over the management of TikTok's US operations to a three-member board, the members of which will be chosen by CFIUS.
2. A subsidiary named TikTok US Data Security will handle all key functions of TikTok in the US, including user data, engineering, security, and content review. This subsidiary will be operated by a committee approved by CFIUS, which will report only to the US federal government and not to ByteDance.
3. Regulatory bodies of CFIUS, including the Department of Justice, Treasury Department, and Department of Defense, have the right to visit TikTok's company at any time and have the authority to veto any of its policies or signed contracts.
4. CFIUS will set hiring policies for TikTok, including requirements that they must be US citizens, must consent to additional background checks, and can be halted from hiring at any time.
5. TikTok must regularly report any internal changes to its source code and content review manual to the relevant authorities. These agencies also have the right to demand that TikTok make "immediate changes" to its source code.
6. If TikTok does not explain the method of implementation to the demands of the relevant authorities within 3 days, the TikTok US subsidiary will have to suspend services to all US users within two days.
According to report, the complete document detailing the aforementioned terms spans 90 pages. Not only from the annual reports of various companies, the restrictions CFIUS has placed on TikTok are far stricter than those it has placed on its American counterparts, such as Facebook. From another perspective, if TikTok really is such a terrifying brainwashing tool to the US government, it should simply ban TikTok outright. With the current developments, CFIUS seems to have acquired a weapon as powerful as Ragnarök from Norse mythology. We have heard many tales of dragon-slaying heroes ultimately becoming the dragons themselves. Changes in power could indeed transform a government into a tyrant, reminiscent of George Orwell's 1984. However, in the past, we never imagined the protagonist of such a narrative to be CFIUS (or the US government for that matter).
